Tight supervision ahead for Apple in Germany

Apple lost its appeal against the competition regulation in Germany, opening the way for stricter supervision to be imposed on the company. The American technology company Apple lost its appeal against the regulation in Germany that introduces a more stringent competition supervision. The German Federal Cartel Office had classified Apple as a company of significant importance for cross-market competition in 2023, intending to impose stricter competition supervision on Apple to prohibit anti-competitive behavior at an earlier stage. Apple had appealed to the German Federal Court (BGH) against this. In its decision today, the court confirmed Apple’s importance in market competition and supported the German Cartel Office’s classification of Apple as a company of significant market importance for competition in 2023. Andreas Mundt, President of the German Federal Cartel Office, welcomed the decision, stating, “This means that the highest court has approved tighter scrutiny of Apple’s abuse of dominance. Therefore, our ongoing review of Apple’s monitoring regulations for third-party applications is on a solid foundation. We are working diligently on this case and other cases against major internet companies.” In January 2022, the German Federal Cartel Office classified Google’s parent company, Alphabet, as of great importance for competition across the market. In May 2022, Meta, the owner of Facebook, and in July 2022, Amazon, were also included in this classification.
