Recently, the incidence of credit fraud victimization is on the rise. Without citizens’ knowledge, loans are being taken out through applications on their own phones. One victim sought the court’s help to avoid paying the debt demanded by the bank. The court ruled in favor of the citizen. Scammers are obtaining loans in the names of others through various methods. They do this by using applications on citizens’ phones. A person who fell victim to a credit scam took their case to the Ankara Consumer Court. They filed a lawsuit against the bank demanding payment. They claimed that 100,000 liras were taken out in their name and 49,437 liras were used from their account. The court concluded that the citizen was not responsible for the debt. According to legal experts, this ruling does not set a precedent for all cases. It is said that each case will be evaluated on its own merits. Lawyer Umut Metin, interpreting the court’s decision, stated, “If it is concluded that the bank did not take security measures, the bank will have to cover the customer’s losses. This is a normal, expected situation. For a binding decision to be made, it must manifest as a Supreme Court precedent. A local decision is only valid for the parties involved in that particular case.”
