Restrictions on Loans Provided by Development and Investment Banks

The Banking Regulation and Supervision Agency (BDDK) placed restrictions on the loans that development and investment banks can provide to individuals or groups. The BDDK determined the credit limit ratios that development and investment banks, excluding Istanbul Takas and Saklama Bankası AŞ and İller Bankası AŞ, can offer. According to the statement made by the BDDK on the subject: “Based on the 43rd paragraph of Law No. 5411 on Banking, as well as the 77th and 93rd articles, and the Regulation on the Determination of Risk Groups and Credit Limits published in the Official Gazette dated 21/12/2023 (Regulation) Article 17; 1) Except for Istanbul Takas and Saklama Bankası A.Ş. and İller Bankası A.Ş., development and investment banks, both on a consolidated and non-consolidated basis, must not exceed the leverage ratio corresponding to the ratio in the table below for the total risk amount of loans they can provide to an individual, legal entity, or risk groups relative to their core capital amounts, 2) For development and investment banks established after 01/01/2020 with a leverage ratio of ten percent or more calculated on a non-consolidated basis at the end of each month, the credit limit ratio percentages in the first paragraph will be applied with a reduction of five points for five years from the date they obtained their operating permits, 3) Regarding the above-mentioned limits, the provisions of the Regulation on determining risk groups, calculating risk amounts, transactions not subject to credit limits, reporting credit limits, compliance with limits, and rectifying breaches will be applied, 4) In the event of breaches of limits for reasons other than bank preferences except for the fourth paragraph of Article 16 of the Regulation, the excess amounts must be rectified by the Institution within a period determined by the Institution, and no administrative fine will be imposed on the bank during this period due to the excesses, 5) Except for loans granted within the risk groups banks are part of, long-term project or investment loans exceeding three years and shares acquired for financing purposes will not be subject to these credit restrictions within the scope of this Decision, 6) If there are excess amounts related to the limits mentioned in the first paragraph as of the date of this Decision, these excess amounts must be rectified by 31/12/2025 by ten percent, by 31/12/2026 by thirty percent, by 31/12/2027 by sixty percent, and by 31/12/2028 by one hundred percent, and if there are excess amounts in the limits mentioned in the second paragraph, these excesses must be rectified within one year, 7) Authorization is granted to the Presidency for extending the mentioned periods and changing exemptions, 8) It is decided to announce this Decision to the Founding Institutions and publish it on the Institution’s website.”
