In Istanbul, the dues of some sites are almost equivalent to a house rent. In fact, in some sites, dues have even exceeded the rent… Experts are warning tenants about unauthorized dues increases and payments that are the responsibility of the landlord. In some luxury sites in Istanbul, dues have exceeded rental prices. In January, the rate of increase in dues in most sites, residences, and apartment buildings ranges from 25% to 100%. Ali Güvenç Kiraz, the President of the Real Estate Law Association, stated, “According to the condominium law, there is no upper limit for dues. In some villa sites along the Bosphorus, dues above 50-55 thousand lira are observed.” Kiraz added, “Security guards, technical personnel, gardeners, pool expenses… A residence might charge 45 thousand lira, another site 25 thousand lira monthly, and a regular site may charge 5 thousand lira in dues.” Unpaid dues have recently started to be taken to court. It is stated that execution proceedings have increased due to dues debts. According to experts, no one is obligated to pay the cost of luxury services outside of common areas. In cases of unauthorized dues increase, objections should be raised at the general assembly. Kiraz said, “For example, if the administration of a site wants to build a baby care room, someone living in the building or the site who is unmarried and has no children is not obligated to participate, this is a luxury expense, they may choose not to pay.” Owners who do not attend the general assembly can file a lawsuit in the civil court within 6 months regarding exorbitant dues.
