Cancellation Decision for Traffic Fine Imposed on Earthquake Survivor

Following earthquakes centered in Kahramanmaraş, a traffic fine imposed on an earthquake survivor from Hatay driving to another city due to the vehicle’s expired inspection was revoked. The Public Complaints Authority’s (PCA) intervention led to the cancellation of the traffic fine issued to the earthquake survivor living in Hatay, as they were traveling from Kahramanmaraş to Bursa when their vehicle’s inspection period had lapsed. According to the amicable resolution decision by the PCA, a resident of Hatay drove to Bursa with their vehicle on 6th February 2023, after the earthquakes centered in Kahramanmaraş. During a police stop, it was revealed through an inquiry that the vehicle’s inspection had expired, resulting in an administrative fine for the driver. The traffic fine report dated 27th February 2023 was served to the driver on 24th May 2024. The driver, seeking assistance from the PCA for the cancellation of the fine, mentioned in their application that due to the state of emergency declared in the provinces affected by the earthquakes in Kahramanmaraş, the inspection period for vehicles was frozen until the end of the state of emergency as announced in the Official Gazette through a Presidential Decree, which ended in May. The driver explained that they had the vehicle inspected in April 2023. Upon reviewing the application, the PCA contacted the General Directorate of Security (GDS) for resolving the issue. The response from the GDS indicated that the owner’s residence was determined to be in one of the cities where a state of emergency was declared, leading to the cancellation of the fine.
